The petitioner seeks bail in Patory P.S. case No. 104 of 2017 under Section 147, 148, 337 of the Indian Penal Code and under Section 3⁄4 of the Explosive Substance Act. The informant alleged that petitioner and others kept bombs in the maize field of the informant.

The learned counsel for the petitioner submits that petitioner and others have falsely been implicated in the case. The informant himself kept explosive in his field and on the statement of petitioner Patory P.S. case No. 103 of 2017 was lodged for recovery of explosive from the field of the informant and thereafter the informant lodged this case implicating the petitioner and others.

No.27781 of 2017 (2) dt.28-06-2017 2/2 Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Samastipur in Patory P.S.
