2. The instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in connection with Kharagpur P.S. Case No. 13 of 2024 instituted for the offence under Sections 341, 323, 147, 379, 427, 307, 504 and 506 of the Indian Penal Code.
3. The case of the prosecution is that the petitioners along with others reached near the house of the informant due to previous enmity. It is alleged that Chandan Pandit and Sunil
Patna High Court CR. MISC. No.76008 of 2024(2) dt.25-11-2024 2/3 Pandit assaulted Sonu Kumar with iron rod who received head injury and his leg and right hand was fractured. The nature of allegation against these petitioner is general and omnibus.

It has been argued by the learned counsel for the appellants has submitted that there is a counter version of this case and that case of kidnapping has been filed by Sarita Devi (wife of petitioner No.4) has filed against the informant and this case has been filed to pressurize the petitioners to compromise in that case. It has been stated that the petitioners are having following criminal antecedent:- (i) Petitioner No.1 is having two criminal antecedent.
(ii) Petitioner No.2 is having one criminal antecedent.
(iii) Petitioner No.3 is having three criminal antecedent.
(iv) Petitioner No.4 is having no criminal antecedent.
(v) Petitioner No.5 is having one criminal antecedent.
(vi) Petitioner No.6 is having two criminal antecedent.
The main thrust of the allegation is against Chandan Pandit and Sunil Pandit who are not petitioners in this case.
5. In contra, learned APP appearing for the State has
Patna High Court CR. MISC. No.76008 of 2024(2) dt.25-11-2024 3/3 opposed the prayer of bail of the petitioners.
6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners on bail. The petitioners are directed to surrender in the Court below within a period of four weeks from today and in the event of their arrest or surrender in connection with Kharagpur P.S. Case No. 13 of 2024, they will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.- IV, Munger subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
