The petitioners apprehend their arrest in connection with Bahadurganj P.S. Case No. 202 of 2019, registered under Sections 370, 372, 376, 120-B, 506 and 323/34 of the Indian Penal Code, pending in the court of the learned Chief Judicial Magistrate, Kishanganj. The accusation is that informant Sabnam @ Amita Kumari met with a boy namely, Munna, who served her intoxicated sweet and after taking the same she became unconscious. Thereafter, she was taken in car with the help of
Patna High Court CR. MISC. No.67299 of 2019(2) dt.14-11-2019 2/3 two others. When she regained her consciousness then she found herself in a room at Sameshwar. The informant made query from Jainab (Petitioner No.2), who disclosed that she was purchased on payment of Rs. Two Lakhs then she started shouting then Juber (Petitioner No.1) and Md. Rijwan (Petitioner No.3) started causing assault to her and said that they purchased her for doing flash trade. Thereafter, both used to commit rape upon her. Before two months Juber (Petitioner No.1) and Md. Rijwan (Petitioner No.3) accompanied her at the house of Rajeev Khalifa and sold her in Rs. Two lakhs. On 07.06.2019, informant, anyhow, succeeded to flee away and came to Kishanganj and performed marriage with one Jamaluddin. Thereafter, Juber and his son Md. Rijwan and Rajeeb came there and gave threatening to her husband and made attempt to take her.
Learned counsel appearing on behalf of the petitioners submits that due to land dispute with the Jamaluddin, husband of the informant, the informant lodged the present case with false allegation.
Having considered the facts and circumstances of the case and the nature of allegation against the petitioners and also the fact that the address of the petitioners and informant are
Patna High Court CR. MISC. No.67299 of 2019(2) dt.14-11-2019 3/3 different, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected.
