Mr.Abhishek Kr. Srivastava CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 10-05-2023 The present writ petition has been filed seeking the following relief:- "1. That this is an application for issuance of an appropriate writ, order or direction particularly in nature of Certiorari for quashing the notice contained in Memo No. 2784 dated 07.10.2022 issued to the petitioners under signature of respondent no. 5 Anchal Adhikari, Motipur for removing of the encroachment on the land of BIADA by 13.10.2022 otherwise action would be taken against them."
At the outset, the learned counsel for the petitioners, the learned counsel for the respondent-State and the learned senior counsel appearing for B.I.A.D.A, Shri Lalit Kishore, are in agreement that the mode and manner, by which the petitioners are being sought to be displaced from the land in question, is not in accordance with law, hence the Ld. Counsel for the respondents seeks liberty on behalf of the respondents to take
4/4 recourse to the due process of law, in case they choose to evict the petitioners from the land in question. Liberty so sought by the respondents is granted.
The writ petition stands disposed off on the aforesaid terms.
