JUSTICE RAJIV ROY ORAL ORDER 04-02-2023 Heard Mr. Amit Kumar, learned counsel for the petitioners and Mr. Bharat Bhushan, learned APP for the State. The petitioners apprehend their arrest in connection with Mohuddin Nagar P.S. Case No. 159 of 2022 for the offence registered under Sections 324 and 307 of the Indian Penal Code and Section 27 of the Arms Act.
As per the prosecution story, the informant a lady alleged that her husband had gone to attend the marriage ceremony of the daughter of Pappu Singh where the petitioner was making 'harsh' firing in which his husband became the unfortunate victim and the bullet hit his body and was rushed to Narayani Hospital, Patna and at the time of lodging of the FIR
Patna High Court CR. MISC. No.67953 of 2022(2) dt.04-02-2023 2/2 was going on treatment in the ICU.
It has regularly be seen that due to the said action/steps taken by the accused persons, innocent lives are being lost in the State of Bihar every now and then and considering the aforesaid facts in the mind, this Court is not inclined to extend any relief to the petitioner and the anticipatory bail stands rejected.
