It appears that the petitioner gave the disputed land to Jagdeo Rai, Chandrika Rai and Vikrama Rai for cultivation and they made hut on the land of the petitioner. A proceeding under section 144 of the Cr.P.C. was also initiated. In fact, the petitioner wants to remove the encroachment and possession of the respondents but the same relief cannot be

The petitioner, if so advised, may take recourse by filing appropriate petition for removal of encroachment or handing over possession to the petitioner. Having considered the facts aforesaid, I do not find any merit in this writ petition. Accordingly, the same is dismissed.
