The petitioner is in custody since 21.08.2019 in connection with Derni P.S. Case No. 47 of 2019 for the offence registered under Sections 30 and 30 (a) of the Bihar Ptohibition and Excise Act.

Learned counsel for the petitioner submits that there is no recovery from the conscious possession of the petitioner but from the house of the petitioner which was made in his absence. It is further submitted that the petitioner has no criminal antecedent.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on

Patna High Court CR. MISC. No.68227 of 2019(2) dt.05-11-2019 2/2 furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of XIth Additional District and Sessions Judge cum Special Judge, Excise Saran at Chapra in connection with Derni P.S. Case No. 47 of 2019.
