The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 419,420,406,481,467,468 and 471 of the IPC.

The prosecution case as per the written report of Sheetal Kumar Jha submitted to the SHO, Jhajha Police Station is to the effect that the informant being the Enquiry Officer of MARICO Limited, a company manufacturing Nihar Natural Badam Aawla Kesh Tel, conducted enquiry to find out as to why the sale of the aforesaid product decreased and during enquiry it was found that the petitioner was supplying the said product by using fake label of the company of the informant.

It is submitted by learned counsel for the petitioner that the accusation has been levelled on mere suspicion and there is

Patna High Court Cr.Misc. No.65370 of 2018(3) dt.17-01-2019 2/2 no recovery from the petitioner. Moreover, the investigation has still not concluded.

Learned APP after going through the case diary, submits that the accusation is corroborated by the seizure as certain packs of fake oil with duplicate stickers and some packs without stickers were recovered from the house of the petitioner. Considering the nature of accusation, this Court is not inclined to grant anticipatory bail to the petitioner in connection with Jhajha P.S. Case No. 157 of 2018 of 2018 pending in the Court of the learned SDJM, Jamui. This application is, accordingly, dismissed.
