2. The petitioner is in custody since 30.08.2023 in connection with Excise Thana Gaya Case No. 1546 of 2023 registered for the offence punishable under Sections 30(a) & 56(b) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, there is recovery of 87 litres of countrymade liquor.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case merely on the basis of suspicion. He further submits that the petitioner has no concern with the alleged recovery of illicit liquor. The petitioner has no criminal antecedents.

5. Learned Additional Public Prosecutor appearing on

Patna High Court CR. MISC. No.68554 of 2023(2) dt.19-10-2023 2/2 behalf of the State has vehemently opposed the prayer for bail.

Considering the facts and circumstances of the case, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Excise Court No. 03, Gaya in connection with Excise Thana Gaya Case No. 1546 of 2023.
