ANJANA MISHRA ORAL ORDER 16-10-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 12.08.2019 in connection with Raushanganj (Banke Bazar) P.S. Case No. 160 of 2019 (G. R. No. 1398 of 2019) registered for the offence under Section 30(a) of the Bihar prohibition and Excise Act. Learned counsel for the petitioner submits that the alleged recoveries were not from the conscious possession of the petitioner but his name has come on the basis of statement of other co-accused persons. It is further submitted that the petitioner has got no criminal antecedent.

Considering the aforementioned facts and circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand)

Patna High Court CR. MISC. No.62920 of 2019(2) dt.16-10-2019 2/2 with two sureties of the like amount each to the satisfaction of the court of learned Special Judge Excise, Gaya in connection with Raushanganj (Banke Bazar) P.S. Case No. 160 of 2019 (G.R. No. 1398 of 2019).
