ANJANA MISHRA ORAL ORDER 12-07-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 414 of the Indian Penal Code.

Learned counsel for the petitioner submits that only on presumption that the two stolen trailers, without number, which were found by the police near the campus of the petitioner, the petitioner has been implicated in this connection with the present case. He further submits that an application has been filed by its owner for release of the said trailer. He next submits that the prosecution against the petitioner was motivated by the some jealous persons who had opposed the Panchayat Samiti Election of the petitioner's wife.

Patna High Court Cr.Misc. No.27528 of 2017 (2) dt.12-07-2017 P2/2 Considering the nature of allegations made and that recovery was not from the conscious possession of the petitioner and also that he has no criminal antecedent, let the petitioner abovenamed, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., VII, Bettiah, West Champaran in connection with Balthar P.S. Case No. 34/2017, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
