2. The petitioner apprehends his arrest in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act.

3. Total 656.820 liters of foreign liquor has been recovered near the village pond.

4. It is submitted on behalf of petitioner that no incriminating article has been recovered from the conscious possession of the petitioner. Recovery has been made from an open place. Petitioner claims clean antecedent.

5. Considering the nature of allegation and clean antecedent of petitioner, let the above named petitioner, in the event of his arrest or surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs.

Patna High Court CR. MISC. No.67274 of 2023(2) dt.19-10-2023 2/2 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise-1, Samastipur in connection with Rosera P.S. Case No. 416 of 2023, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
