2. The petitioner apprehends his arrest for the offences alleged under Sections 323, 325, 341, 379, 406, 498(A) of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act registered in connection with Complaint Case No. 585 of 2016.

3. It is submitted that the petitioner has been falsely implicated and this is the first such complaint of its nature since the parties were married almost two decades ago. The accusation of demand of dowry and inflicting cruelty are denied. In any event the petitioner expresses his readiness and

Patna High Court CR. MISC. No.60838 of 2019(3) dt.05-03-2020 2/2 willingness to keep the opposite party no. 2 with due dignity and honour. The matter was sent to mediation but did not fructify in amicable settlement of the dispute as the opposite party no. 2 did not wish to reside with the petitioner. The petitioner offers to make payment of Rs. 3,000/- per month to the opposite party no. 2 till conclusion of the trial.

In the above view of the matter, the provisional anticipatory bail granted to the petitioner by order dated 26.09.2019 pending in the Court of Sub-Divisional Judicial Magistrate, Saharsa in connection with Complaint Case No. 585 of 2016 shall stand confirmed subject to the further condition that the petitioner shall deposit a sum of Rs. 3,000/- per month regularly before the learned Court below till conclusion of the trial which shall be available for withdrawal by opposite party no. 2. If the petitioner fails to deposit any two consecutive instalments, his bail bond shall be liable to be cancelled by the learned Court below.
