JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-07-2018 The present contempt petition has been filed complaining non-compliance of the order dated 16.04.2012 passed in CWJC no. 21275 of 2011, whereby and whereunder the University authorities were directed to take a decision with regard to the claim of the petitioner within three months from the date of receipt/ production of a copy of this order.

The learned counsel appearing for the Lalit Narayan Mishra University, Darbhanga has filed a show cause wherein a copy of the notification dated 03.07.2018 has been annexed, whereby and whereunder the petitioner has been directed to be regularized in the services of the University w.e.f.

Patna High Court MJC No.783 of 2013 (8) dt.17-07-2018 2/2 18.10.2011. In the said notification, it has also been mentioned that the payment of the salary and arrears thereof, shall be subject to release of funds by the State Government.

In view of the aforesaid notification issued by the Registrar of the University dated 03.07.2018, I find that the order dated 16.04.2012 has been fully complied with. In such view of the matter, there is no reason to proceed further in the matter, however the petitioner is granted liberty to agitate his grievance, if any, by way of filing a fresh representation. Nonetheless, it is directed that the salary and arrears thereof, should be released and paid to the petitioner within a period of six weeks from today. The contempt petition is disposed of.
