====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 01-10-2019 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 406, 409, 420, 467, 468, 471, 341, 323, 504 and 506 of the Indian Penal Code. Petitioner is Head of the Customer Service Point of Bank of Baroda in village Bistoria in the district of Araria. There was a bank account of Siyavati Devi, wife of Asarfi Rishidev. In the Account of Siyavati Devi twice rupees forty thousand was transferred under the Prime Minister Awas Yojna (Gramin). Submission of learned counsel for the petitioner is that both times money was transferred to the bank account of Siyavati Devi and she withdrew the money on different occasions which would be evident from Annexure-2. Considering the submission aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Raniganj Police Station Case No. 249 of 2019, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
