The petitioner apprehends his arrest in connection with Amarpur P.S. Case no. 194 of 2016, registered under Sections 323, 201, 498A and 504 of the Indian Penal Code.

The accusation is that the marriage of the informant was performed with the petitioner before 15 years, but before three years, petitioner performed his re-marriage and thereafter, started torturing to his wife (informant) mentally and physically and also started demand of Rs. 25,000/-, as dowry, while she arranged Rs. 10,000/- from her

Patna High Court Cr.Misc. No.64567 of 2018(3) dt.05-02-2019 2/3 Myaka and matter was pacified, but she was again being tortured by the petitioner. Later on, on 19.09.2013, she was removed from her matrimonial house along with her children.

Learned counsel for the petitioner submits that, admittedly, the marriage of the petitioner was performed before 15 years of filing the present complaint case, while informant was stayed at her matrimonial house with the petitioner about five years and two children were born due to their wedlock, but later on, she came in the company of one Vijay Singh and started to live with him and due to their wedlock, one baby was also born and only to harass the petitioner, the informant lodged Complaint Case No. 1963 of 2013, which was sent under Section 156(3) of the Cr.P.C. on which present case has been lodged.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Banka in connection with Amarpur P.S. Case No. 194 of 2016,
