JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-11-2019 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 304B/34 of the Indian Penal Code.

Petitioner happens to be father-in-law of the deceased. It is admitted case of the prosecution that the marriage of deceased had taken place in the year 2013 and she died in the year 2019. Moreover, the impugned order goes to show that the doctor, who did postmortem report examination on the dead body of the deceased could not ascertain the cause of death and the viscera was sent to Forensic Science Laboratory for chemical examination. No.66518 of 2019(2) dt.04-11-2019 2/2 petitioner has already been completed and apart from that, the mother-in-law of the deceased has already been granted privilege of bail by a coordinate Bench of this Court vide order dated 21.10.2019 passed in Cr. Misc. No. 63705 of 2019. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Bikramganj, District Rohtas, in connection with Sanjhauli P.S. Case No. 26/2019.
