2. The petitioner is apprehending arrest in connection with Jale P.S. Case No. 76/2024 registered on 09.04.2024 for the offences punishable under Sections 341, 323, 338, 325, 379, 504, 307, and 506/34 of the Indian Penal Code.

As per the prosecution, the F.I.R. has been lodged against four named accused persons alleging therein that they have brutally assaulted the informant and the family members due to the reason that the informant's son did not allow the accused persons to make a road on the agricultural land of the informant.

4. It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.75848 of 2024(2) dt.12-11-2024 2/2 that the petitioner is innocent and has committed no offence. In fact, due to the previous enmity and dirty village politics, the petitioner has been made accused in this case. The petitioner and the informant are the residents of the same village. Moreover, the alleged date of occurrence is 06.04.2024 at about 7.00 A.M. but the said FIR was lodged on 09.04.2024 at about 02.30 P.M. which is after the lapse of 36 hours while the distance between the place of occurrence and the police station is just 8 K.M. The antecedent of the petitioner is clean.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

In the facts and circumstances, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of 6 weeks from today, on furnishing bail bond of ₹30000/- (thirty thousand) with two sureties of the like amount each to the satisfaction of the ACJM-1, Darbhanga, in connection with Jale P.S. Case No. 76/2024, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
