The petitioners seek pre-arrest bail in connection with Karakat P.S. Case No. 127 of 2019 for the offence alleged under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The accusation is that on receiving secret information about keeping the liquor by the petitioners in their house, informant, along with other police officials, reached there and on search two liters of country made liquor recovered from where Sheela Devi, wife of petitioner no. 2, Mulchand Yadav, was apprehended, who disclosed the name of her husband and devar, petitioner no. 1, Dhanjee Singh, indulged in selling the liquor.

No.60524 of 2019(2) dt.24-09-2019 2/2 The submission of the learned counsel for the petitioners is that it would appear from the first information report that the petitioners, being the brother-in-law and husband of Sheela Devi have been implicated in this case. Both the petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the petitioners, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Karakat P.S. Case No. 127 of 2019 shall be released on bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional District & Sessions Judge IIcum-Special Judge, Excise, Rohtas at Sasaram, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
