This application, for grant of anticipatory bail, arises out of Patliputra Police Station Case No. 390 of 2022, dated 01.07.2022, disclosing offences under Sections 419/420 of the Indian Penal Code.

This is a case of impersonation inasmuch as the brother of the petitioner appears in the skill test (typing test) of SSC CHSL in place of the petitioner.

Learned Counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and the allegation in the First Information Report of impersonation is against co-accused Avinash Kumar, who is the brother of the petitioner.

No.241 of 2023(2) dt.15-05-2023 2/2 Regards being had to the submissions made on behalf of the parties and taking into consideration the fact that this is a case of impersonation and the petitioner is a student, aged about 25 years, I am inclined to grant the petitioner privilege of anticipatory bail.

This application is, accordingly, allowed.

Let the petitioner, Abhishek Kumar, in the event of her arrest or surrender before the Court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 10th Additional Chief Judicial Magistrate, Patna, in connection with Patliputra Police Station Case No. 390 of 2022, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
