JUSTICE RAKESH KUMAR ORAL ORDER 05-05-2016 At the very outset, Sri Sanjiv Sharan, learned counsel, who has appeared on behalf of Opp.Party no.2, in presence of learned counsel for the petitioner and Sri Ahmad Ali, learned Addl. Public Prosecutor, submits that the petitioner, in the present petition, has prayed for quashing of an order rejecting the criminal revision filed by the petitioner against the order of rejection of discharge petition, whereas before the court below sufficient development has taken place. He submits that after framing of charge, till date altogether seven prosecution witnesses have already been examined.

In view of submission made by learned counsel for Opp.Party no.2, the Court is of the opinion that virtually the

Patna High Court Cr.Misc. No.30843 of 2013 (2) dt.05-05-2016 2/2 present petition has become infructuous.

The petition stands dismissed as the same has become infructuous.
