2. The petitioner is apprehending his arrest in connection with Laheri P.S Case No. 204 of 2021 dated 24.05.2021 registered for the offence punishable u/s 420, 406, 504, 506/34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner and the coaccused person are alleged to have sold the share of the land of the informant from which he got 30,00,000/-. Thereafter, when the informant asked for his share of the sold property, he was abused and threatened to be implicated in a rape case by the accused persons.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It further submitted that it is a case of civil dispute. The petitioner and the informant are the full brother and the informant

Patna High Court CR. MISC. No.73079 of 2024(2) dt.11-12-2024 2/2 has misbehaved and assaulted the petitioner's wife as such Laheri P.S. Case No. 203 of 2021 has been lodged against the informant by the daughter of the petitioner. The co-accused person has already been granted anticipatory bail by this court vide order dated 12.02.2024 passed in Cr. Misc. No. 1342 of 2024. The petitioner has one criminal antecedent as stated in para 3 of the bail petition.

5. Learned A.P.P. for the State has vehemently opposed the prayer for anticipatory bail of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, as well as the nature of allegation, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court concerned, Nalanda, Bihar Sharif in connection with Laheri P.S Case No. 204 of 2021 subject to conditions as laid down under section 438(2) of the Code of Criminal Procedure.

7. The application stands allowed.
