The petitioner is in custody in connection with Sherghati P.S. Case No. 199 of 2019 for the offences under Sections 10, 13, 18, 20, 38 and 39 of U.P.A. Act. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 05.05.2019. He further submits that allegation against the petitioner is that he is member of Naxalite organization. Learned counsel for the petitioner submits that at the time of his arrest nothing incriminating was recovered from the possession of the petitioner not even the Naxalite literature.

Considering the fact that petitioner has no criminal antecedent, the Court is inclined to grant bail to the petitioner,

Patna High Court CR. MISC. No.63499 of 2019(2) dt.17-10-2019 2/2 let the petitioner, named above, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Court of learned Additional Chief Judicial Magistrate, Sherghati (Gaya) in connection with Sherghati P.S. Case No. 199 of 2019, subject to condition that one of the bailor should be elected representative of local body.
