The petitioner is apprehending his arrest in a case registered under Sections 147, 341, 323, 342, 354(B), 376, 504 of the Indian Penal Code and 3⁄4 of the Dowry Prohibition Act. Allegation against the petitioner is that he established physical relationship with the informant on assurance of marriage. It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The allegation made in the F.I.R. is denied. The informant wanted to get married with the petitioner, which was not acceptable to the family of the petitioner and for the said
Patna High Court Cr.Misc. No.28655 of 2017 (2) dt.06-07-2017 2/2 reason the present case has been filed to put pressure upon the family of the petitioner.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Purnea in connection with Bhawanipur P.S. case No.17 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
