2. The petitioners have preferred this application for grant of regular bail in connection with Kankarbag P.S. Case No. 286 of 2025 dated 03.04.2025 registered for the offences punishable under sections 303(2) and 317 of the B.N.S.
3. As per the prosecution case, the informant alleged that on 02.04.2025, he had parked his motorcycle (Yamaha R15M, Reg. No. BR01HJ7590) near Lane No.1, Chanmari Road, Patna. When he returned, the motorcycle was missing and despite search, he could not find it.
4. Learned counsel for the petitioners has submitted
Patna High Court CR. MISC. No.67063 of 2025(2) dt.13-10-2025 2/3 that the petitioners are innocent and have falsely been implicated in this case. The petitioners are not named in the FIR. The names of the petitioners have sprung up in this case during the course of investigation. The charge-sheet has been submitted against the petitioners. Nothing has been recovered from the conscious possession of the petitioners. The petitioners have no concern with the alleged offence. The petitioner no.1 has two criminal antecedents and the petitioner no.2 has one criminal antecedent as stated in para 3 of the bail petition. The petitioners are in custody since 19.06.2025. The co-accused person has already been granted regular bail by the Co-ordinate Bench of this Court vide order dated 10.09.2025 passed in Cr. Misc. No. 63879 of 2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioners.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioners above-named, are directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court concerned, Patna, in connection with Kankarbag P.S. Case No. 286 of 2025.
