JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-09-2019 The present writ petition has been filed to direct the respondent authorities to remove the encroachment made by the private respondents over the public Nala situated at Khairatia, P.S.-Manuapul (Muffasil), District-West Champaran at Bettiah. This Court is of the view that in case the petitioner seeks removal of encroachment from the public land, he should approach the Circle Officer, Chanpatiya, District-West Champaran at Bettiah by filing appropriate complaint under the provisions of the Bihar Public Land Encroachment Act, 1956. Accordingly, the present writ petition stands disposed off as withdrawn with the aforesaid liberty and in case an appropriate complaint is filed before the Circle Officer, Chanpatiya Block, District-West Champaran at Bettiah, he would examine the same and proceed further in accordance with the provisions of the Bihar Public Land Encroachment Act, 1956.
