2. The petitioner seeks bail in a case registered for the offence punishable under Section 30 (a) of the Bihar Prohibition and Excise Act.

3. The present application for regular bail has been filed in view of the fact that earlier the bail bonds of the petitioner was not accepted in view of the order dated 20.05.2025 passed in Cr. Misc. No.32515 of 2025, whereby the petitioner had been granted bail but upon verification, criminal antecedent was found to be not matching inasmuch as three more cases of similar nature were found pending against the petitioner. The modification application to the aforesaid order was also rejected vide order dated 11.07.2025 with a liberty to file a fresh application which would be taken into

Patna High Court CR. MISC. No.65454 of 2025(2) dt.12-09-2025 2/2 consideration by the learned Court concerned.

4. In view of the fact that the petitioner had already been granted bail but the bail bonds could not be furnished on account of discrepancy in the criminal antecedent and is in custody since 02.04.2025, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Khagaria Excise P.S. Case No.97 of 2025, subject to the condition that:

(i) One of the bailors will be his close relative or family member, preferably, father, mother, brother, sister and/or his wife.

(ii) The petitioner shall remain physically present in court on each and every date till the charges are framed and in the event of failure on two consecutive dates without sufficient reasons, his bail bonds shall be liable to be cancelled by the learned court concerned.
