2. The petitioner seeks bail in a case registered for the offence punishable under Sections 25(1-B)(a), 26 and 35 of the Arms Act.
3. The allegation in the First Information Report is that one country-made katta and one live cartridge were recovered from the possession of the other co-accused persons, while knife was recovered from petitioner.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is submitted that knife is said to have been recovered from the possession of the petitioner. So far as the recovery of firearm and one live cartridge is concerned, the same was recovered from the possession of co-accused, Vikas Kumar, who has already been granted privilege of bail by a Co-
Patna High Court CR. MISC. No.67945 of 2025(3) dt.19-12-2025 2/2 ordinate Bench of this Court vide order dated 15.10.2025 passed in Cr. Misc. No. 67102 of 2025. The petitioner has no criminal antecedent and charge-sheet has already been submitted.
5. Learned APP for the State opposed the grant of bail on the basis of allegation made in the First Information Report.
6. Taking into consideration the facts and circumstances and considering the fact that the petitioner has no criminal antecedent and charge-sheet has already been submitted, coupled with the fact that one of the co-accused persons has already been granted bail by a Co-ordinate Bench of this Court, let the above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra/concerned Court below in connection with Madhaura P.S. Case No. 493 of 2025.
