The petitioner apprehends arrest in a case registered under Sections 341, 324, 326, 307, 504,34, 302 of the Indian Penal Code and 27 of the Arms Act.

The prosecution case in brief is that on the point of installing tubewell, an altercation took place and in consequence of the informant was fired upon as a result of which, he sustained injuries and became senseless.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been falsely implicated in the present case. The main allegation of firing is alleged against the co-accused

Patna High Court CR. MISC. No.68787 of 2019(2) dt.16-11-2019 2/2 namely, Makko Mahto. So far as the petitioner is concerned, he is member of unlawful assembly. No allegation of assault is alleged against the petitioner.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisasrai in connection with Lakhisarai (Amhara) P.S. Case No. 258 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
