2. The petitioner has preferred this application for grant of regular bail in connection with Sessions Trial No. 214 of 2024 arising out of Chandi P.S. Case No. 73 of 2023 dated 07.03.2023 registered for the offences punishable u/ss 147, 148, 149, 323, 337, 338, 326, 307, 302, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act.
3. As per the prosecution case, while the informant was at his home, the petitioner and the co-accused persons came and started assaulting and pelting stones upon him. When the informant's son tried to say something then all the accused persons fired due to which the informant's son sustained injury
Patna High Court CR. MISC. No.67094 of 2025(2) dt.13-10-2025 2/3 and fell down and further due to indiscriminate firing, the other persons also got injured. They were taken to the hospital for treatment where the doctor declared one Dhanu Singh dead and the other injured persons were referred to Patna.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner has been made accused in this case merely on suspicion. There is no specific allegation against the petitioner. The co-accused persons have already been granted regular bail by this court vide order dated 25.07.2023 passed in Cr. Misc. No. 40102/2023. Nothing has been recovered from the conscious possession of the petitioner. The charge has been framed in this case on 24.01.2025 and out of fourteen chargesheeted witnesses, three witnesses have been examined only. The petitioner has two criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 31.07.2024.

Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner and submitted that the regular bail and anticipatory bail application of the petitioner were earlier rejected twice by the Coordinate Bench of this court vide order dated 27.02.2025 passed in Cr. Misc. No. 83662/2024
Patna High Court CR. MISC. No.67094 of 2025(2) dt.13-10-2025 3/3 and vide order dated 05.01.2024 passed in Cr. Misc. No. 82051/2023 respectively. Learned counsel has further submitted that P.W. 1 in his deposition has stated that the petitioner and the co-accused, Babua jee fired on the deceased which hit his rib and hand.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Bhojpur at Ara in connection with Sessions Trial No. 214 of 2024 arising out of Chandi P.S. Case No. 73 of 2023 with the condition :- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
