Mr Anshuman Singh, CGC ====================================================== CORAM: HONOURABLE MR JUSTICE MADHURESH PRASAD ORAL ORDER 04-11-2019 Writ petition is claiming grant of benefit of compassionate appointment. The petitioner, wife of deceased Head Constable/General Duty of the respondent-Force has sought quashing of the decision of the respondent-Authorities declining the benefit of compassionate appointment on account of medical deficiency on the parameter of vision. Learned counsel for the Union of India, placing reliance on averments made in the counter affidavit, submits that the petitioner has already been granted the following benefits:

5. That as per nomination of family details submitted by No 851181054 HC/GD Bibhuti Prasad Singh of A/4 BN before expiry Smt Manimala Singh is wife (NOK) and two minor sons namely Amit Kumar Singh (DOB - 27.3.1996) and Vinit Kumar

Patna High Court CWJC No.2559 of 2012(4) dt.04-11-2019 2/2 Singh (DOB - 08.02.1998).

Details of pensionery/financial benefits have already been remitted to NOK of deceased i e Smt Manimala Singh are as under:- (i) Rs 10,000/- in which amount of immediate financial assistance.

(ii) Rs 7,50,000/- in which amount of Central Government Risk Premium final payment.

(iii) Rs 1,51,637/- in which amount of GPF final payment.

(iv) Rs 4,10,000/- in which amount of DCRG.

(v) Rs 53,256/- in which amount of GIS.

(vi) Family pension @ 6080/- per month vide PPO No 23903 - 11- 0039 - 1 It is also submitted that in view of the averments made in the counter affidavit, earlier the petitioner's counsel had obtained time to ascertain whether rejoinder is required in the matter. Matter was, accordingly, adjourned on 14.03.2013. None appears for the petitioner.

Without going into the merits of the submission advanced by the learned counsel for the Union of India, writ petition is dismissed for want of prosecution. (Madhuresh Prasad, J) M.E.H./- U
