JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-11-2019 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offences punishable under Sections 341, 342, 324, 326, 307, 120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act, later on Section 302 of the IPC was added. According to the prosecution case itself, it was FIR named co-accused Md. Faroqe, who shot fire on the deceased and so far as the petitioners are concerned, it is only alleged that they were also present over the place of occurrence when the alleged occurrence took place.
