The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 302, 120B of the Indian Penal Code and Section 27 of the Arms Act. Murder of two persons was committed by someone. One of the deceaseds' was brother of the informant. When the informant got information, he went to the hospital where both dead bodies were there. Subsequently, the informant came to know from the villagers that four persons had fired at the two dead persons including the petitioner. However, none of the villager has stated before the police that they had seen the petitioner or anyone firing at the deceased.
Considering the fact that there is no substantial

No.59865 of 2018(4) dt.20-12-2018 2/2 material against the petitioner to directly indulged in the crime alleged, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending in connection with Bidupur Police Station Case No. 166 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
