JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-06-2019 This is an application for grant of anticipatory bail in connection with N.D.P.S. Case No. 5 of 2018 arising out of Buxar (Town) P.S. Case No. 451 of 2018, disclosing offences under Sections 8 (C) 20 (b) (ii) (A) of the N.D.P.S. Act. Allegation of recovery of 44 grams of Ganja from the possession of the petitioner, who is Warden of the jail. Submission of the learned counsel for the petitioner is that he has lodged a complaint against one B.M.P.-5 Constable. He has falsely been implicated in this case. There is no compliance of Section 50 of the N.D.P.S. Act and moreover, recovered ganja is of small quantity. Considering the said facts, he has granted provisional bail.
Heard learned A.P.P. also.
Having heard both sides, from perusal of the case
Patna High Court CR. MISC. No.66425 of 2018(3) dt.27-06-2019 2/2 diary, it appears that petitioner has been granted provisional bail in this case. As such, provisional bail granted to the petitioner, vide order dated 14.12.2018 is confirmed.
With the aforesaid observations, this application is allowed.
