ANJANA MISHRA ORAL ORDER 16-10-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 14.08.2019 in connection with Excise Case No. 522 of 2019 registered for the offence under Sections 30(a) and 56(B) of the Bihar prohibition and Excise Act.

Learned counsel for the petitioner submits that the alleged recoveries were not from the conscious possession of the petitioner but only because he was the driver of the Bolero Car in which the said recoveries were made, he is being prosecuted.
