1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 118(1), 117(2), 352, 351(2), 109 and 3(5) of the B.N.S., 2023.
3. Learned counsel for the petitioner submits that petitioner has antecedent of one case under the Excise Act. It is next submitted that Pramod Ram along with five others had approached this Court seeking anticipatory bail by filing Cr. Misc. No.48817/2025. It is submitted that in Cr. Misc. No.48817/2025, anticipatory bail was granted to all the petitioners except petitioner no.3, Manjit Ram by an order dated
Patna High Court CR. MISC. No.69755 of 2025(2) dt.30-10-2025 2/3 12.08.2025 passed by a learned Coordinate Bench. It is next submitted that the learned Coordinate Bench had considered the Cr. Misc. No.48817/2025 on merits and in detail. It is further submitted that case of this petitioner is similar to the case of Toofani Ram, who was granted the privilege of anticipatory bail by a learned Coordinate Bench by an order dated 12.08.2025 in Cr. Misc. No.48817/2025.
4. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner but then is not in a position to rebut the submission of the learned counsel appearing on behalf of the petitioner that allegation against this petitioner and Toofani Ram is similar in the FIR.
5. Considering the submissions made by the learned counsel for the petitioner and also taking into consideration the order dated 12.08.2025 in Cr. Misc. No.48817/2025 passed by a learned Coordinate Bench, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Bagaha P.S. Case
