1. Heard learned counsel for the parties.
2. The petitioners have preferred this application for grant of regular bail in connection with Barun P.S. Case no. 357 of 2023, registered under sections 420, 414, 419, 467, 468, 471, 120B and 34 of the Indian Penal Code.
3. As per the prosecution case, the petitioner no.2 was caught with a stolen motorcycle. The petitioner no.1 who was also sitting on the motorcycle managed to escape.
4. Learned counsel for the petitioners submits that no incriminating article has been recovered from the petitioners' possession. They have been falsely implicated in the case. They have no criminal antecedent and are in custody since 30.7.2023.
Patna High Court CR. MISC. No.68883 of 2023(2) dt.01-11-2023 2/2 Charge-sheet has been submitted in the case.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and taking into consideration the allegations in the FIR, their being in custody since 30.7.2023, charge-sheet having been submitted in the case and especially the petitioners not having any criminal antecedent, the petitioners are directed to be enlarged on bail in connection with Barun P.S. Case no. 357 of 2023, on each of them furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Aurangabad.
