1. Heard learned counsel for the petitioner and the learned APP for the State.

2. The petitioner seeks bail in a case registered for the offences punishable under Sections 306 and 34 of the Indian Penal Code.

3. Learned counsel appearing on behalf of the petitioner submits that petitioner is a person with clean antecedent and is in custody since 27.07.2025. It is next submitted that the allegation as alleged in the FIR is that petitioner and other accused persons abetted in suicide of her father.

4. The learned counsel for the petitioner submits that similarly situated co-accused Vijay Singh @ Vijay Prakash

No.66349 of 2025(2) dt.26-09-2025 2/3 Singh had approached this Court seeking anticipatory bail by filing Criminal Miscellaneous No. 64188 of 2025 and the same was allowed by an order dated 17.09.2025. It is next submitted that like Vijay Singh, the petitioner had also given loan to the brother of the informant, but when the time to return the loan came, the amount was not returned and in lieu whereof two cheques of Rs. 9,90,000/- each were issued by the brother of the informant in the name of the petitioner, but then the cheques on presentation for encashment bounced, thereafter, the petitioner also like Vijay Singh used to visit the house of the informant for claiming their money back when the occurrence is alleged to have taken place.

It is also submitted that no doubt a suicide note was left by the deceased, but then the same did not record the correct facts that loan was taken and the same was not returned in lieu whereof the petitioner used to visit the house of the informant. It is next submitted that petitioner will not abscond rather will cooperate in the trial to prove his innocence.

5. Learned APP for the State opposes the bail application of the petitioner.

6. Considering the submissions made by the learned counsel for the petitioner and taking into consideration the order dated 17.09.2025 in Criminal Miscellaneous No. 64188 of 2025,

No.66349 of 2025(2) dt.26-09-2025 3/3 the petitioner above-named, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Muffasil P.S. Case No.711 of 2023.

7. One of the bailors of the petitioner shall be his mother namely Sarita, who is a government school teacher.

8. It is further made clear that if the learned Trial Court comes to a conclusion that petitioner, after his release, is trying to delay the framing of charge or after framing of charge is trying to delay the trial, in both the conditions, the learned Trial Court shall be at liberty to cancel the bail bonds of the petitioner.

9. Accordingly, the instant bail application is allowed.
