JUSTICE SANDEEP KUMAR ORAL ORDER 01-11-2023 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Laukaha P.S.Case No. 206 of 2023 for the offence punishable under Section 372, 373 of the Indian Penal Code and Section 3⁄4 of Immoral Traffic Prevention Act and section 6/8 of POCSO Act.

It is alleged that the petitioner was caught with the victim girl Punam Kumari, while they were crossing the Border from Nepal side.

Learned cousnel for the petitioner submits that during investigation the victim girl recorded her statement under section 164 of the Cr.P.C in which she stated that she had got married with Barkat Ali and the petitioner was friend of Barkat Ali. The petitioner has got clean antecedent and he is in custody

Learned APP has vehemently opposed the prayer of bail.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Learned Additional Sessions Judge 7th cum- Special Judge POCSO, Madhubani in connection with Laukaha P.S. Case No. 206 of 2023.
