(i) For a direction upon the Respondents to take proper action against the encroachers who have been encroached the land of public Road/passage and drainage of water used by the villagers for years having Plot no.1017, 1009 and 937 under Khata no.208 in village- Nawgarh, Circle- Ekangarsarai, District- Nalanda for which an Encroachment case no.18/2023/2024 has been drawn by the Circle Officer, Ekangarsarai and after notice to the Encroacher the same is pending before the Circle officer for proper action against the encroacher but the circle officer is sitting tight over the encroachment proceeding for undisclosed reasons.

Patna High Court CWJC No. 15450 of 2025(2) dt.04-11-2025 2/2 (ii) To issue direction upon the Respondent no.4 Circle Officer Ekangarsarai to proceed in accordance with law for removing the encroachment from public road in village Nawgarh, P.S.- Telhara, Circle office- Ekangarsarai under the Encroachment case no.18/2023/2024 pending before him in which after issuance of notice dated 11-07-2024 to nine encroachers nothing have been done by the Circle Officer to remove the encroachment.

(iii) To issue direction upon the Respondent no.5 to support the circle officer in removing the encroachment from public road in Village - Nawgarh in which the report of Karmchari and Anchal Ammen clearly Shows that ten persons have encroached the land of public road and the villagers are facing problem to commute on the said road.

(iv) To issue other proper writ/order/direction/orders to the ends of justice.

2. From the perusal of the records, it appears that Encroachment Case No. 18/2023-2024 is pending before the Circle Officer, Ekangarsarai (respondent No. 4).

3. Accordingly, respondent No. 4 is directed to dispose of the said encroachment case after hearing all the concerned parties, in accordance with law.
