Mr. AC to AAG-13 ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJIV ROY ORAL ORDER 10-11-2025 Heard Mr. Dhananjay Mishra, learned counsel for the petitioner and the State.
2. The present petition has been preferred for the following relief/s:
(i) for a direction to the Circle Officer, Sonepur, Saran for measurement of land of petitioner bearing Khata No. 90, Khesra No.
440 Rakba 07.5 dhur (Seven Katha five dhur) under Mauza Ismailchak, Sonepur and to erect the pillar after the demarcation of
Patna High Court CWJC No.16345 of 2025(2) dt.10-11-2025 2/3 land;
(ii) for a direction to provide the police force at the time of measurement and demarcation for keeping the peace, if any disturbance create by adjacent plots;
(iii) to provide any other relief/reliefs for which the petitioner is entitled for..
3. The submission of the petitioner through the learned counsel is that despite approaching all the respondents, no one is taking note of the claim put forward by him.
4. Upon query, learned State Counsel submits that if the fresh petition is filed, the State shall be taking appropriate steps.
5. In that background, this Court deems it appropriate to dispose of the writ petition allowing the petitioner to approach both the Deputy Collector, Land Reforms, Sonepur at Saran as also the Circle Officer, Sonepur at Saran in next three weeks with fresh petition alongwith the supporting documents who shall be duty bound to take steps and after noticing the parties, shall fix date for measurement and accordingly take the matter to its logical conclusion otherwise the concerned respondents are also duty bound to record the facts which
Patna High Court CWJC No.16345 of 2025(2) dt.10-11-2025 3/3 has/have prevented them from taking the matter to its logical conclusion.
6. With the aforesaid observation, the writ petition is disposed of.
7. It is expected that the entire exercise shall be completed by 31.03.2026.
