The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 365, 370, 370(A), 120B of the Indian Penal Code and Section 14A(ab)/14C of the Foreigners Act. As per prosecution story, acting upon the secret information, the informant apprehended the accused persons i along with two women (citizens of Uzbekistan) who were being brought to India illegally from Nepal by the two apprehended Indian citizens on their motorcycles. Upon making inquiry from this petitioner, he disclosed that on order of one Indal Mukhiya he was doing the alleged act.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has

There is no specific role of this petitioner mentioned in FIR for committing the alleged offence. It is further submitted that this case stands on similar footing of co-accused Sunil Kumar Mehta who is already getting the privilege of bail granted by a co-ordinate Bench of this Court vide order dated 16.11.2022 passed in Cr. Misc. No. 41839 of 2022. Moreover, the petitioner is languishing in judicial custody since 13.4.2022. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Birpur P.S. Case No. 98 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-I, Supaul.
