JUSTICE BIBEK CHAUDHURI ORAL ORDER 18-11-2025 The petitioner is a superannuated Lady Supervisor in the District of Madhepura in ICDS Project. She was appointed on 18th December, 1985. During her service, she was granted first ACP w.e.f. 9th August, 1999. However, even after her retirement, she was not granted 1st & 2nd MACP.

2. Learned Advocate for the petitioner has referred to Annexure-4 being Letter No. ICDS/10041/01-2020 496, dated 23rd January, 2020, wherein it is clearly stated that the Lady Supervisors under the ICDS are entitled to get ACP/MACP according to their length of service.

3. Learned Advocate for the petitioner next draws my attention to Letter No. 15321/ICDS, dated 14th October, 2022 (Annexure-8) written by District Program Officer to the

Patna High Court CWJC No.15879 of 2025(2) dt.18-11-2025 2/3 Secretary to the Divisional Commissioner requesting him to put up the matter before the Divisional Commissioner for grant of ACP/MACP to the petitioner to relieve him of her financial hardship.

4. The grievance of the petitioner is that till date the said letter was not disposed of by the Divisional Commissioner.

Learned Advocate for the State-respondents submits that the instant writ petition may be disposed of directing the Divisional Commissioner, Koshi Division, Saharsa (respondent no. 2) to disposed of the letter dated 14th October, 2022, within a specific period of time, so that the petitioner can get her relief.

6. In view of such submissions and on due consideration of the fact that the instant writ petition is disposed of, directing the respondent no. 2, Divisional Commissioner, Koshi Division, Sarsha to dispose of the letter dated 14th October, 2022 to come to a specific decision, as to whether the petitioner is entitled to get her 1st & 2nd MACP or not and in case of her entitlement, he shall pass necessary order within four weeks from the date of communication of this order.

7. Parties are at liberty to act on the server copy of the order.
