JUSTICE SHAILENDRA SINGH ORAL ORDER 26-09-2025 The instant writ petition under Article 226 of the constitution of India has been filed by the petitioners seeking the following reliefs:- "(I) The communication dt.28.06.2025 issued under the signature of respondent Circle Officer whereby and where under while the petitioner no.1 along with one another has been communicated that he occupied a private land of the respondent no.7 bearing Khata No.367, Chak

Patna High Court CWJC No.15220 of 2025(2) dt.26-09-2025 2/3 No.880 having an area of 29 decimal and the petitioner no.2 along with one another bearing Khata No.367, Chak No.988 having an area of 14 decimal with a direction to appear before the Janta Darbar on 12.07.2025 according to the order passed by the respondent Deputy Director in Appeal No.12/1990 as also order of this Hon'ble Court, otherwise the respondent no.6 will pass the order an ex-party, be quashed.

(II) The respondents be restrained from interfering with the right, title interest of the petitioners in summary proceeding in any view of the matter.

(III) The petitioner be extended any other relief/ reliefs for which the petitioner be found entitled."

2. Heard Mr. Surya Kant Mishra, learned counsel for the petitioners and Mr. Sajid Salim Khan, learned SC 25 for the State-respondents.

The main grievance of the petitioners is with regard to the communication dated 28.06.2025 issued by the Circle Officer, Bandra, Muzaffarpur, respondent no.6 whereby it has been informed to the petitioners that one person had filed an application making an allegation against the petitioners that they had made forceful possession over the land detailed in that communication and upon that the petitioners as well as the

Patna High Court CWJC No.15220 of 2025(2) dt.26-09-2025 3/3 second party- Krishnanandan Thakur have been directed by the Anchal Adhikari to appear before him and file their response on that communication.

4. In view of the nature of issue raised by the petitioners, concerned to the said communication, this court is of the view that the petitioners have not made out a case for invoking writ jurisdiction of this court.

5. Accordingly, this writ petition stands dismissed. (Shailendra Singh, J) BKS/- U
