JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-01-2019 Petitioner apprehends his arrest in connection with Budha Colony P.S. Case No. 232 of 2018 registered for the offences punishable under Sections 272, 273/34 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act.
Allegation is of recovery of more than 300 litres of liquor from the hut of one Sunny Kumar and allegation is that petitioner and Sunny Kumar are engaged in liquor business and he is accused in two more cases of similar type. Submission of learned counsel for the petitioner is that nothing has been recovered from his possession and he has falsely been implicated in this case.

Having heard both sides and in the facts and
Patna High Court Cr.Misc. No.73176 of 2018(3) dt.25-01-2019 2/2 circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, rather he should surrender and make prayer for regular bail, which shall be considered on its own merit, without being prejudiced by this order.
With the above observation, this application is dismissed.
