Case No. 36 of 2017 registered for the offence(s) under section(s) 406, 409, 420, 379, 414, 467, 468, 471, 401/34 Allegation against the petitioner is of recovery of 10 A.T.M. from his possession and he could not explain about the same.
Submission of the learned counsel for the petitioner is that the petitioner has clean antecedent and he has been made accused only on the basis of suspicion and he is in custody for about five months.
Heard learned Additional Public Prosecutor also. Having heard both sides and in view of the facts and
Patna High Court Cr.Misc. No.31694 of 2017 (2) dt.14-07-2017 2/2 circumstances as stated above, I am not inclined to grant bail to the petitioner. However, the petitioner may renew his prayer for bail after framing of charge in this case and the Court below will consider the materials against him and will pass an appropriate order without being prejudiced by the order of this Court. Accordingly, this application is dismissed.
