Patna High Court CWJC No.8811 of 2017(19) dt.17-02-2020 2/3 commanding and directing the respondent authorities to remove the encroachment made upon the land of Forest Department Govt. of Bihar under differents Forest Sub-division in the State of Bihar especially Kaimur and Nalanda district as encroached by encroachers, which is apparent from the information provided under Right to Information Act by the Public Information Officercum-Sub-Divisional Officer (Forest), Kaimur Forest Sub-division, Kaimur at Bhabhua and Nalanda Forest Sub-division, Nalanda at Biharsarif and a direction to the respondents to constitute a committee for the purpose to enquire the entire encroachment upon forest land under the State of Bihar. and/or other relief which may be granted in consequence thereto the fact and circumstances as ensuing."
We are dealing with the encroachment made over forest area in two districts, Kaimur and Nalanda. We appreciate the efforts put by the petitioner in approaching the court, for from the affidavit filed by the State, it is now apparent that encroachments over the forest land have been removed save and except one encroachment where a temple stands.
As such, we close the proceeding clarifying that the authorities shall take all steps either legalizing such unauthorized, illegal possession or removing the same.
