The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 341, 323, 324, 325, 354(A), 376, 511 of the Indian Penal Code and Sections 4/5 of the POCSO Act.
The allegation against the petitioner is of trying to commit rape upon the informant, when she was alone in her room. Thereafter, the informant protested then accused assaulted her and also took out a knife from his pocket and hurled both sides of her neck.
Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has

After prevailing good sense between the parties, compromise took place, Compromise Petition is annexed as Annexure-2. He has got no criminal antecedent as stated in para-3 of the bail application. It is further submitted that the petitioner is languishing in judicial custody since 22.07.2022. Learned APP appearing for the state has opposed the prayer of regular bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Pupri P.S. Case No. 239 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, VI-cum Special Judge (POCSO Act), Sitamarhi.
