2. This application has been filed on behalf of the petitioner for quashing the Memo No. 53 dated 20.05.2020 issued by the Secretary to the Government, Law Department, Bihar.

3. The limited argument advanced by learned senior counsel for the petitioner that the order granting sanction dated 20.05.2020 may be quashed as no material has been discussed by the then Law Secretary on which the sanction has been granted.

4. Upon perusal of the order granting sanction, it appears to be a cryptic and non-speaking order and the same cannot be sustained.

5. In view of the above, this application is allowed.

6. Accordingly, the Memo No. 53 dated 20.05.2020 issued by the Secretary to the Government, Law Department, Bihar is hereby quashed.

7. The State is given liberty to pass a fresh sanction order in accordance with law. If it is decided to pass a fresh sanction order then the authorities must consider the fact that the petitioner has been exonerated in the Departmental Proceeding and will also consider the various judgment of the Hon'ble Apex Court on this issue.
