This happens to be third attempt of the petitioner asking for grant of an anticipatory bail. The additional ground happens to be that the main accused Binay Sahani @ Binay Kumar Sahani had already been granted regular bail vide order dated 09.01.2017 relating to Criminal Miscellaneous No.55666/2016 as well as co-accused Raj Kumar Sahani @ Raj Kumar Chaudhary had already been granted anticipatory bail vide order dated 10.02.2017 passed in Criminal Miscellaneous No.251/2017 in the background of having the case compromised amongst the parties. The learned lower court will consider those eventualities while considering the prayer for bail of the petitioner .
